1. Agreement
By accessing nowstack.ai, starting a trial, creating an account, or clicking to accept, you agree to these Terms, the Privacy Policy, Cookie Policy, Acceptable Use Policy, and (if you start a trial) the Trial and Billing Terms(together, the “Policies”). If you do not agree, do not use the service.
2. The service
NowStack, Inc. provides web software for operations: Command Center, tasks, communications, CRM, and AI agents. Features change. We may add, change, or remove functionality. We do not publish invented seat or credit list prices on the marketing site; the amount you pay is the amount Stripe shows at checkout and on receipts, plus any credit top-ups you buy.
The service is provided as a paid subscription after a 7-day trial unless we agree otherwise in writing. We do not commit to a public uptime SLA on this site. Enterprise SLAs, if any, are only in a signed order form.
3. Eligibility
You must be at least 18 years old and able to form a binding contract. The service is for business use, not for children. You confirm you meet this requirement. You may not use the service if you are prohibited from receiving US software or payment services.
4. Accounts
- Provide accurate signup information and keep it current.
- You are responsible for credentials, API keys, and everyone you invite.
- Notify us promptly of unauthorized access.
- One workspace must not attempt to read another tenant. Circumventing isolation is a material breach.
- We may refuse, reclaim, or rename a workspace that impersonates another party or is reserved.
5. Acceptable use
You will not use the service to break the law, send unlawful or unsolicited bulk messages, exploit minors, attack systems you do not own, or bypass security or tenant isolation. The full list, including enforcement and immediate removal (“boot”) for noncompliance, is the Acceptable Use Policy, which is incorporated here.
6. Your content
You retain ownership of data you upload or create (“Your Content”). You grant NowStack a limited, non-exclusive, worldwide license to host, process, transmit, and display Your Content solely to provide, secure, and support the service, including sending necessary context to subprocessors and model providers.
We do not use Your Content to train a NowStack-owned foundation model. We do not keep Your Content after you delete it except as described in the Privacy Policy (backups, billing, security, and law).
You warrant that you have the right to upload client, employee, and prospect data you store, and that doing so does not violate third-party rights or law.
7. Generated output
As between you and NowStack, you own output the service generates for your workspace, subject to third-party model terms and any third-party rights in the output. You may use it for lawful business purposes, including commercial use.
- You must verify accuracy, citations, and legal fitness before you publish or send anything.
- You are responsible if output infringes trademarks, copyright, publicity, or privacy rights.
- AI-generated content may not qualify for copyright in every jurisdiction.
- Studio images and video are synthetic. They are not photographs of real people or places unless you supplied those assets. Resemblance can be coincidental.
- Human-in-the-loop approvals do not shift that responsibility to NowStack. Approving a draft is your act.
8. AI disclaimer
Output is produced by probabilistic models. It may contain artifacts, inaccuracies, invented facts, or unexpected results. NowStack is an operations tool, not a source of legal, medical, financial, or factual authority. We are not liable for decisions you make based on agent output. Third-party model providers’ terms also apply to the prompts you send them.
9. Third-party services
The service depends on processors listed in the Privacy Policy, including Vercel, Neon, Stripe, Mailgun, Ably, Upstash, and optional Google, Microsoft, and GitHub connections. AI models are routed through Vercel AI Gateway to providers configured for the workspace. Their terms and privacy policies apply to data they receive. We are not responsible for a third-party outage or a change in a vendor’s terms.
10. Trial, fees, and cancellation
Trial signup uses Stripe Checkout in subscription mode with a 7-day trial period. You must provide a payment method. We do not charge the subscription fee during those 7 days. If you do not cancel before the trial ends, Stripe converts the subscription to paid and charges the price shown at Checkout and on Stripe receipts. Credit top-ups, when offered, are a prepaid pool (the product meters usage; one credit equals USD $0.01 when that meter applies).
Cancel anytime during the trial to avoid the conversion charge. After conversion, fees are billed by Stripe on the cycle shown at Checkout. Failed payment may put the subscription in dunning; we may suspend the workspace. Except where law requires otherwise, paid fees and unused trial days are non-refundable. Taxes may apply. Full mechanics are in the Trial and Billing Terms.
11. Intellectual property
NowStack owns the software, UI, trademarks, documentation, and templates. You own Your Content and, as stated above, generated output. You receive a limited, non-transferable, non-sublicensable license to use the service during a current trial or paid term. You will not copy, scrape beyond ordinary use, reverse engineer, or resell the service except as we allow in writing.
12. Suspension and termination
You may stop using the service and cancel the Stripe subscription. We may suspend or terminate access immediately, with or without notice, if we believe you have violated the Policies, failed to pay, created risk to other tenants, or if we are required to by law. That includes removing (“booting”) the workspace and invited users. We are not obligated to provide a refund for unused time when we terminate for cause.
Provisions that by nature should survive (including acceptable use, IP, disclaimers, liability, indemnity, and governing law) survive termination. After termination we handle data as described in the Privacy Policy.
13. Disclaimer of warranties
The service is provided on an “as is” and “as available” basis, without warranty of any kind, express or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, title, and non-infringement. NowStack does not warrant that the service will be uninterrupted, error-free, or secure, or that AI-generated output will be accurate, appropriate, or free of infringing content.
14. Limitation of liability
To the maximum extent permitted by law, NowStack and its suppliers are not liable for indirect, incidental, special, consequential, lost profits, lost data, or punitive damages, or for the cost of substitute services.
Our total liability for all claims in the aggregate is limited to the fees you paid us for the service in the three months before the claim (or USD $100 if you have paid nothing).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the maximum extent permitted by law, and the above limitations may not apply to you.
15. Indemnity
You will indemnify and hold harmless NowStack and its officers, contractors, and suppliers against claims, damages, and reasonable legal fees arising from Your Content, your use or your users’ use of the service (including agent output you send), your violation of the Policies, or your violation of law or third-party rights.
16. Governing law and venue
These Terms are governed by the laws of the State of Delaware and the United States, without regard to conflict-of-law rules. Exclusive venue for disputes is the state or federal courts located in Delaware, except where mandatory consumer, employment, or data-protection law requires another forum. Notices to NowStack, Inc. may be sent to 2810 North Church Street, STE 90443, Wilmington, DE 19802, USA, or via nowstack.ai/contact.
17. Changes
We may update these Terms. Material changes will be posted with a new “Last updated” date (currently September 24, 2026). Your continued use after changes are posted constitutes acceptance of the revised Terms. For significant changes we may also email the account owner or require re-acceptance.
18. Contact and copyright
Questions about these Terms: /contact. For alleged copyright infringement on content hosted in the service, send a DMCA-style notice through that form with: your contact details, the work claimed, the URL or workspace location, a statement of good-faith belief, a statement under penalty of perjury that you are authorized, and your signature. We may remove content and, for repeat infringement, terminate accounts.
